AUS DEM INHALT
Unter dem Begriff der Sozialhilfe verstehen wir einen Teilbereich des Systems der sozialen Sicherung in Deutschland. Hinter dem Begriff versteckt sich das Ziel soziale Notlagen durch individuelle Leistungen abzuwenden, in dem die hierfür notwendigen Dienste und Einrichtungen durch den Staat bereitgestellt werden. Man spricht hier auch vom Fürsorgeprinzip (vgl. Schellhorn 2000). Bevor ich allerdings auf die genaue Herkunft der Sozialhilfe zu sprechen komme, erachte ich eine genaue Definition dieses wichtigen Bausteins der sozialen Sicherung als überaus wichtig. Begrifflich lässt sich die Sozialhilfe definieren als:
„Die planmäßige auf gesetzlicher Vorschrift beruhende individuelle Hilfe durch besondere öffentliche Träger (in Zusammenarbeit mit der freien Wohlfahrtspfle-ge) zur Verhütung, Beseitigung oder Milderung von persönlichen und wirtschaft-lichen Notständen bei Personen, die sich nicht selbst helfen können und die Hilfe auch nicht von anderer Seite erhalten.“

Mit Wirkung zum 01.01.2005 wurde das alte BSHG aufgehoben und durch das neue SGB XII ersetzt. Man spricht hier auch von einer vollkommenen Neukodifi-zierung und Zusammenführung von Sozialhilfe und Arbeitslosenhilfe, d. h. das neue SGB XII steht im Zusammenhang mit dem SGB II, welches nun nach §21 SGB XII für hilfebedürftige Arbeitssuchende vorrangig heranzuziehen ist (vgl. Möller 2005). Diese Neufassung des Sozialhilferechts zieht weitreichende Verän-derung nach sich, welche alle Bereiche der Sozialhilfe gleichsam beeinflusst. Ei-nem dieser Bereiche möchte ich mich nun in der vorliegenden Arbeit widmen. Die Rede ist vom Bereich der Hilfe zum Lebensunterhalt. Ziel dieser Arbeit wird es sein, die bisher geltenden Regelungen des BSHG den neuen Regelungen des SGB XII gegenüberzustellen, um zu ermitteln, welche Veränderungen sich aus der Neufassung der Sozialhilfe ergeben haben. Beginnen werde ich damit, die allgemeinen Grundsätze der Sozialhilfe aus dem BSHG und SGB XII gegenüber-zustellen, um zu ermitteln, ob sich die grundsätzlichen Intensionen dieses Be-reichs der sozialen Sicherung verändert haben. Im Anschluss werde ich mich schließlich explizit der Hilfe zum Lebensunterhalt widmen, indem ich die bisher geltenden Regelungen aus dem BSHG ausführlich darstellen, um im darauf fol-genden Kapitel auf die Veränderungen aus dem SGB XII einzugehen. Eine Zu-sammenfassung und das dazugehörige Fazit bilden den Schluss dieser Arbeit.
