Teilweise hat es die Polizei bereits übernommen, den Verkehrsunterricht durch eigene Angebote sicherzustellen, teilweise unternimmt sie – z. T. gedrängt durch die Politik – erste Schritte in Richtung auf eine entsprechende Einrichtung des Unterrichts.
An dieser Stelle sind kritische Fragen über den Stellenwert, aber insbesondere auch über die rechtlichen Verantwortlichkeiten gestattet, die es der Polizei ermöglichen, sich angemessen und ihrem gesetzlichen Auftrag angepasst zu positionieren. Zuvor jedoch einige grundsätzliche und einführende Anmerkungen.
Die Vorschrift des § 48 StVO über den Verkehrsunterricht führt insgesamt ein unverdientes Schattendasein im deutschen Straßenverkehrsrecht. Sie ist in ihrer konkreten Anwendbarkeit und ihrem praktischen Gebrauchswert für das soziale System Straßenverkehr bislang dogmatisch zu wenig ausgelotet und wird von allen in der Verkehrssicherheitsarbeit tätigen Institutionen insgesamt zu wenig beachtet. Dabei schlummert in dieser Vorschrift ein ungeahntes Potenzial für die Verbesserung der Verkehrssicherheit .
Wenig nachvollziehbar ist es, wenn allenthalben über mangelnde Verkehrssicherheit, nachlassende Verkehrsmoral und Verkehrsrowdytum geklagt wird, auf der anderen Seite aber nahe liegende staatliche Reaktionsmöglichkeiten wie der Verkehrsunterricht gem. § 48 weder angemessen beachtet noch zeitgerecht fortentwickelt bzw. situationsbezogen genutzt werden.
Der Verkehrsunterricht ist in diesem Zusammenhang zwar eindeutig kein Allheilmittel für die Bewältigung aller Probleme um die Verkehrssicherheit im Straßenverkehr, bietet aber deutliche Potenziale zu wirklichen Chancen auf deren allgemeiner Verbesserung – allerdings nur unter der wichtigen Vorbedingung, dass neue innovative Konzepte entwickelt werden.
Einerlei, wer die Verantwortung für den Verkehrsunterricht auch trägt, so bleibt die Prämisse klar: Verkehrsunterricht ist gelebte Verkehrsprävention in der Form von wirksamer Spezialprävention!
