Doch wenn man sich genauer damit beschäftigt, muss man feststellen, dass der Begriff Gewalt eine lange und durchaus nicht immer negative Tradition hat. Im Grundgesetz Artikel steht geschrieben : "Alle Staatsgewalt geht vom Volke aus."1 In diesem Fall leitet sich der Gewaltbegriff vom althochdeutschen Wort "waltan" ab, und bedeutet herrschen. Hier wird der Gewaltbegriff also durchaus nicht negativ betrachtet. Viele Staaten der Welt werden durch Gewaltenteilung regiert. Der Gewaltbegriff wurde erst zur Zeit der Aufklärung anders definiert. In diesem Zusammenhang sei auf die prinzipielle Gleichheit aller Menschen hinzuweisen. Früher war es nur legitim, dass der Hausherr seine Frau und seine Kinder, züchtigte. Ein tiefgehender Wandel hat sich seit den 70er Jahren entwickelt. Den Kindern wurden Rechte zugeschrieben, und diese von dem Staat gefestigt und überwacht. Man gründete eine Vielzahl von Betratungsstellen in Erziehungsfragen. Gewalt gegen Kinder wurde verächtet.
Die Kinderschutzbewegung der 70er Jahre hat folgende Definition gegeben : "Die Misshandlung von Kindern umfasst die Gesamtheit der Lebensbedingungen, der Handlungen und Unterlassungen, die dazu führen, dass das Recht der Kinder auf Leben, Erziehung und wirkliche Förderung beschnitten wird. Das Defizit zwischen diesen Rechten und ihrer tatsächlichen Lebenssituation macht die Gesamtheit der Kindesmisshandlung aus."2
